Boehner’s Lawyer Abandons Sinking Ship Known As Obama Lawsuit
More bad news for Sad Orange Man, AKA the Weeping Cheeto.
David L Rivkin Jr. – who was handling the frivolous lawsuit filed on behalf of House Republicans against President Obama – has withdrawn from the case.
The lawsuit, brainchild of the Republican Speaker of the House, John Boehner, accuses the President of overstepping the powers of the President. Rivkin, who took on the case in August has now backed away from the ill-advised action after pressure from his partners who feared association with it will hurt their business.
From the very beginning the suit has been seen as nothing more than political gamesmanship. The President himself responded when the suit was first filed;
“The suit is a stunt, but what I’ve told Speaker Boehner directly is, ‘If you’re really concerned about me taking too many executive actions, why don’t you try getting something done through Congress?”
The viability of the case has been in question from the beginning. Democrat Stan Brand, former general counsel to the House of Representatives said,
“It’s a hare-brained idea. I think there’s a case to be made that Obama has exceeded the recent history of executive overreaching, but I don’t know that it’s remediable in court — or should be.”
Ironically now, whatever chance the lawsuit did have is further eroded by the defense being put together by Republican Rick Perry in his own trial on corruption charges as Governor of Texas. Perry’s lawyer, in summing up his case called his charges,
“…nothing more than an effort to weaken the constitutional authority granted to the office of Texas governor, and sets a dangerous precedent.”
Any argument he makes on Perry’s behalf will then bolster the President’s argument in this one.
This is one more notch against the lawsuit which is costing taxpayers $500/hr and likely total in the millions. Eventually it will be thrown out of court, but in the meantime it has been a boon to the Democrats who have raised millions from concerned citizens angry with a GOP more concerned with political shenanigans than in doing anything that could help the country.
